Scope
This Consent applies to all communications, disclosures, notices, terms and conditions, and other documents related to Unison’s products. This Consent will remain effective until expressly withdrawn by you.
Electronic Delivery of Communications
By (i) checking the box next to “Terms of Use, Consent to Electronic Communications and Signatures, Credit Use Authorization, and Privacy Notice, or (ii) clicking “I confirm”, “I agree”, or a similar button, you agree that delivery of electronic documents or communications electronically will be considered “in writing”, and that you intend that the electronic documents or communications to have the same legal effect as written and signed paper documents or communications. This includes electronic communications related to your account from Unison’s third party servicers. You specifically consent to receive electronic communications and disclosures regarding your account instead of by regular mail.
All communications that we provide to you electronically will be provided either (i) directly to any email address provided on your application (or any email address you provide to us later) or (ii) via our Website. Documents may be delivered to you in a .pdf format. We may also notify you through email when communication(s) or updated agreement(s) pertaining to our Website are available.
Electronic Signatures
By (i) checking the box next to “Terms of Use, Consent to Electronic Communications and Signatures, Credit Use Authorization, and Privacy Notice”, or (ii) clicking “I confirm”, “I agree”, or a similar button, you acknowledge that you have read, understand and agree to the following:
- You are voluntarily choosing to sign certain Unison documents electronically;
- You understand that the documents we present on our Website will replace the use of paper documents;
- You understand and agree that your electronic signature will bind you to the terms and conditions to the same extent as if you signed your Unison documents on paper with an ink signature;
- You understand and agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and Unison; and
- You understand that you have the right to withhold your consent to the use of electronic documents and signatures, and that you have the right to withdraw your consent at any time prior to completing the e-sign process. Please be aware, however, that withdrawal of consent may result in the termination of your access to use Unison products.
Hardware and Software Requirements
Before you consent, you should consider whether you have the following required hardware and software capabilities to access, view and retain electronic communications:
- A connection to the internet;
- An internet browser (e.g., Firefox, Chrome, Edge, Explorer, Safari);
- A computer or mobile device and an operating system capable of supporting the above;
- A PDF file reader, such as the free Adobe® Acrobat Reader (http://get.adobe.com/reader);
- A printer if you wish to print and retain paper records, and electronic storage if you wish to retain records in electronic form; and
- An active and valid email address (your email address on file with Unison).
We will notify you of any changes to these requirements that create a risk that you may not be able to receive communications electronically.
By giving your consent you are confirming that you have access to the necessary equipment and are able to receive, open, and print or download a copy of any communications for your records.
Withdrawing Your Consent
You may withdraw your consent to receive communications electronically by contacting us via the “Contact Us” link at unison.com/contact. Your withdrawal of consent will become effective after we have had a reasonable opportunity to act upon it. If you withdraw your consent, the legal effectiveness, validity and/or enforceability of prior communications will not be affected.
If you fail to provide consent, or if you withdraw your consent to receive Communications electronically, Unison reserves the right to either deny your application for a Unison product, restrict or deactivate your online account, close your account, or charge additional fees for paper copies.
Requesting Paper Copies
You may request a paper copy of any communication by contacting us via the “Contact Us” link at unison.com/contact. You acknowledge Unison reserves the right to charge you a reasonable fee for the production and mailing of paper versions of communications, unless charging a fee is prohibited by applicable law.
Updating Your Contact Information
You must promptly inform us of any change in your email address by signing into your online account and updating your email address or contacting us via the “Contact Us” link at unison.com/contact.
Acknowledgement
By (i) checking the box next to “Terms of Use, Consent to Electronic Communications and Signatures, Credit Use Authorization, and Privacy Notice”, or (ii) clicking “I confirm”, “I agree”, or a similar button, you acknowledge that you can access communications that are provided to you by the methods described above and agree to receive communications electronically.
